المنتدى العراقي لمنظمات حقوق الإنسان يتضامن مع إضراب المعلمين ويدين جريمة تصفية المحتجز المهندس بشير

أصدر المنتدى العراقي لمنظمات حقوق الإنسان بيانين مستقلين تبنى في الأول مطالب المعلمين التربويين في العراق وأكد تضامنه التام معهم بخاصة في الرد على ما تعرضوا له من قمع في احتجاجات الناصرية فيما دان في البيان الثاني جريمة تصفية المهندس بشير خالد الذي قضى تحت التعذيب تلك الظاهرة المتكررة في مراكز الاحتجاز والسجون العراقية مطالبا بتحقيق ذي صدقية ومعاقبة المسؤولين وتنظيف تلك المؤسسات من الممارسات الإجرامية ونهجها.. وقد ساهم المرصد السومري لحقوق الإنسان في البيانين إلى جانب منظمات المنتدى في داخل الوطن والمهجر

السلطة تقمع الحق الدستوري، في الإضراب دفاعا عن الحقوق والمطالب المشروعة العادلة

في خطوة خطيرة، واصلت سلطاتٌ محلية نهجَ قمعِ الاحتجاج السلمي؛ بتصديها لإضراب المعلمين. وقد اختارت ذلك الفعل، في ذي قار؛ ما لا يُعفي السلطات الاتحادية من مسؤوليتها حتى عندما يجري ارتكاب تلك الانتهاكات في محافظة أو أخرى؛ لأنَّ المعنى من ذلك النهج وما ارتكبه، يجسِّد دلالة في إطلاق تهديد للابتزاز، ويوحي بأن تلك الاحتجاجات ستتعرض للقمع بصورة فظة كما الذي تعرض له المعلمون في ذي قار، حيث أصيبت معلمات شاركن بالاحتجاج مثلما زملائهن المعلمين..

إن نهج التعرض للاحتجاج قد طاول من قبل جموعَ الخريجات الجامعيات والخريجين والكسبة والفقراء وأصحاب الحقوق المهضومة واليوم يتعرض له التربويون والمعلمون المطالبون بحقوقهم باستخدام الحق الدستوري في الحراك السلمي..

ولقد تمادت تلك السلطات عندما أقدمت على خروق دستورية وانتهاكات حقوقية باقتحام المدارس وتفتيشها ورصد من تغيَّبَ عن الدوام الرسمي بقصد توجيه الاتهامات الباطلة حتى لمن كان بحال اضطرار في عدم تمكنه من الحضور.. وفيما هو أبعد من ذلك، ما أقدمت عليه قوى الداخلية من اعتقالات للنشطاء والملاكات التعليمية التربوية ومن الموظفين بأكثر من محافظة..

إن المنتدى العراقي لمنظمات حقوق الإنسان يؤكد شجب تلك الانتهاكات ويرى فيها تهديدا مباشرا وترهيبا القصد من ورائه ابتزاز الحركة المطلبية للفئات المحرومة ممن يقع تحت مستوى خط الفقر؛ بسبب أوضاع البلاد بخاصة منها ظواهر التضخم والأزمات الاقتصادية المختلفة عدا عن الحرمان من حق عادل في مساواة هذه الشريحة من حيث الحصول على موارد العيش الحر الكريم..

كما نرى أن منع الحركة المطلبية من ممارسة حقها الدستوري في الاحتجاج ومنه ممارسة الإضرابات السلمية والاعتصامات التي تمثل أداتهم في الدفاع عن الحقوق والحريات، إنما تجسد فعليا أخطر الانتهاكات الصارخة تجاه الحقوق والحريات العامة وهي المكفولة دستوريا والمثبَّتة في لوائح حقوق الإنسان ومواثيقها التي وقع عليها العراق والتزم بتنفيذها.

إنَّنا نشدد على أن نهج القمع وترهيب الحراك السلمي المشروع، لا يمثل حلا بأي شكل وصورة لأي من مشاكل طرحتها وتطرحها الفعاليات الاحتجاجية السلمية، الأمر الذي يستدعي الإصغاء إليها وتلبيتها بلا تأخير يعقّد الأوضاع أكثر ..

ولعل ظواهر إطلاق الوعود – رفقة القمع – هي مجرد مسكنات وهمية لن تدوم في مهمة تجاوز المعضلات البنيوية التي يتسم بها الاقتصاد الريعي بكل ما يعانيه من ندوب إشكالية هيكلية خطيرة بخاصة هنا غياب العدالة الاجتماعية ومجمل أسس العيش الكريم..

إن حركتنا الحقوقية والمنتدى يقفان بثبات وقوة مع الحركة الاحتجاجية السلمية في مطالبها المشروعة العادلة وفيما تحمل من رسائل وبرامج هي الحل وهي البديل.. متضامنين مع مجمل المطالب المشروعة، التي نراها باقية رفقة الضغط الجماهيري الواسع دفاعا عن الحقوق. والحريات وعن خيار الشعب في مطالبه من جهة وفي خياره دولة مدنية تلبي نهج العدالة الاجتماعية والمنظومة الديموقراطية الكفيلة بتلبية الحقوق..

ونحن نؤكد المطلب الأساس الذي تتقاسم مهامه الكفاحية الحقوقية قوى الشعب ليس بالاكتفاء بتلبية المطالب ووقف الانتهاكات بل وفي محاسبة كل من ساهم بالقمع وإيقاع أشد العقوبات المنصوص عليها دستوريا..

معا وسويا حتى تحقيق تلك المطالب التي تعيد للمعلم مكانه ومكانته وللعملية التربوية نهجها السليم بمسؤولية كاملة للدولة التي تحمي، لا التي تعتدي وتنتهك.. ولتتوقف الوعود الوهمية وأضاليل العبث مع الحراك السلمي المشروع فورا…

Contrary to the constitution, the Iraqi authorities are suppressing the constitutional right to strike in defense of legitimate just rights and demands.

In a dangerous move, the Iraqi authorities continued their approach of suppressing the peaceful protests of teachers in their strike, choosing to do so in Dhi Qar province. This does not absolve federal authorities of responsibility, even when these violations occur in one of the governorates. This approach and its implementation embody the threat of blackmail and suggest the brutal suppression of these protests, as happened with teachers in Dhi Qar, where female teachers participating in the protest were injured, along with their colleagues.
Previously, targeting protests aimed also at university graduates, professionals, self-employed, the poor, and those whose rights have been violated. Today, it targets educators and teachers demanding their rights by exercising the constitutional right to peaceful protest. These authorities have overstepped their bounds in the violation of constitutional and human rights, storming and searching schools, monitoring absentees, and even bringing false charges against those forced to attend. The Interior Ministry’s arrests of activists, educational cadres, and employees have multiplied in more than one governorate.
The Iraqi Forum for Human Rights Organizations condemns these violations, viewing them as a direct threat and with an intimidating objective. This violation of the deprived segments of society living below the poverty line, particularly amid the country’s economic conditions, particularly inflation and various economic crises, further deprives this segment of its just right to equal access to the resources necessary for a free and dignified life. We also believe that preventing the movement from exercising its constitutional right to protest, including peaceful strikes and sit-ins, which represent its tools for defending rights and freedoms, effectively represents the most serious and egregious violations of public rights and freedoms, guaranteed by the Iraqi Constitution and stipulated in the human rights conventions and agreements signed by Iraq and committed to implementing. We affirm that the repression and intimidation of a legitimate peaceful movement does not represent a solution in any way to any of the problems raised by the peaceful protest movements. This calls for listening to them and responding to them instead without delay, and which only further complicates the situation.

Perhaps issuing promises—along with repression—is merely an illusion that will not last long in overcoming the structural problems that characterize the rentier economy, with all its serious structural scars, foremost among them the absence of social justice and the foundations of a decent life. Our human rights movement and the Forum stand firmly and resolutely with the peaceful protest movement in its legitimate and just demands, and in its messages and programs, which represent a solution and an alternative. We stand in solidarity with all legitimate demands that we see as permanent, alongside the widespread public pressure in defense of rights and freedoms. We stand in solidarity with the people’s choice in their demands, on the one hand, and in their choice of a civil state that upholds the principles of social justice and a democratic system capable of upholding rights.

We emphasize the fundamental demand shared by all human rights struggle forces: not only to meet demands and stop violations but also to hold accountable all those who contributed to the repression and impose the harshest penalties stipulated in the constitution.

Together, we must work together until these demands are met, restoring the status and position of teachers and returning the educational process to its proper path. The protecting state bears full responsibility. Let the false promises and illusions that hinder legitimate peaceful movements cease immediately.

أشد إدانة لجريمة تصفية المهندس بشير خالد ولكل أشكال التعذيب المحرَّمة التي تُرتكب خلف القضبان.

فضح بالأمس انكشاف جريمة جديدة أخرى، اُرتُكب فيها أشدّ أنواع التعذيب، حد التصفية الجسدية للمهندس… ولعل ذلك ليس حادثة فردية معزولة؛ إلا أنَّ طابع الإخفاء والتستر وفرض السرية المطلقة على أساليب التعذيب خلال التحقيقات في مراكز الاحتجاز والسجون هو ما يسم الحقيقة بخاصة مع تسرّب عدد من تلك الوقائع وما تؤشره من انتهاكات فظة بذرائع لا تصمد أمام نصوص لوائح الحقوق وقوانينها

إنَّنا في الحركة الحقوقية والمنتدى العراقي لمنظمات حقوق الإنسان، نشدّدُ بجانب الإدانة؛ على مطالب فتح مؤسسات السجون والاحتجاز أمام الحركة الحقوقية وتوفير الحماية القانونية للمعتقلين والسجناء كافة باطلاع ذويهم على أماكن وجودهم احتجازا أو سجنا مع المحاكمات العادلة والحماية من التعذيب وأشكال الانتهاكات ومنها ما تسرب في وقت سابق بشأن الاغتصاب والتهديد به للابتزاز وانتزاع الاعترافات تحت التعذيب الوحشي المفرط..

إن ما آل إليه تعذيب الضحية الجديدة بوفاته يفرض إلزاما فتح تحقيق فوري عاجل وتوفير فرصة مساهمة كاملة للمحامين ونقابتهم ومفوضية حقوق الإنسان والمنظمات الحقوقية العراقية وجمعية الحقوقيين العراقيين، ولجنة حقوق الإنسان النيابية مع ضرورة إشراك طرف حقوقي أممي وأيضا حضور مباشر لـ(يونامي) بقصد طمأنة ذوي الضحية إلى تلبية حقوقه وإيجاد ضمانات لم يحظ بها في حياته؛ بما انكشف بفقدانه حياته قبل أن تتسرب الحقيقة وتفتضح..

إن مجمل ما يجري خلف القضبان بكل تلك السرية والتعتيم تفضي إلى تلك النتيجة الكارثية وما تعنيه بمعاجم الحقوق والحريات ليس عراقيا حسب بل وأمميا دوليا؛ وهو الأمر الذي يتطلب تضامنا عالميا شعبيا ورسميا بما يوفر الضغط المناسب لتلبية المطالب العادلة ومنع تكرار الجريمة

ونحن نرى أن التلكؤ والمماطلة ستكون إدامة لنهج التكتم وتمرير الانتهاكات بصورة ممنهجة بالضد من حقوق المواطن في الحماية والعدالة..

فلتنتهِ تلك الانتهاكات ولنتحول بالسجن ومركز الاحتجاز إلى مؤسسة للعدالة وكشف الحقيقة وليس مراكز انتقام ثأرية أو أماكن انتهاكات وتبرير لغايات لا تخضع لقانون أو لائحة حقوقية.. ولتتحقق مطالب إحالة المسؤولين عن التعذيب والاعتداء على الضحايا إلى القضاء مهما كانت رتبهم ودرجاتهم الوظيفية ولابد في ضوء معطيات الواقعة الأخيرة من معاقبة المحتجزين الذين اعتدوا على الضحية وفي سياق المهام الأكثر عمقا وشمولا من إدخال درس متحصص بحقوق الإنسان لأفراد الشرطة ضباطا ومنتسبين وتدريبهم في إطار ذلك السياق…

كل التضامن مع عائلة الضحية في التوصل إلى كفالة حق ابنها ولو بعد رحيله ومصادرة حقه في الحياة

Strongest condemnation of the crime of assassinating Engineer Bashir Khaled and all forms of forbidden torture committed behind bars.
Yesterday, another new crime was exposed, in which the most severe forms of torture were committed, to the point of physically assassinating the engineer. While this may not be an isolated incident, the nature of concealment, cover-up, and the imposition of absolute secrecy on torture methods during interrogations in detention centers and prisons is what clouds the truth, especially with the leaking of a number of these incidents and the blatant violations they indicate, under pretexts that do not stand up to the principles of human rights regulations and laws.
We, in the human rights movement and the Iraqi Forum for Human Rights Organizations, stress, in addition to condemnation, on the demands to open prison and detention institutions to the human rights movement and provide legal protection for all detainees and prisoners, without falsely informing their families of their whereabouts, whether in detention or imprisonment, with fair trials and protection from torture and other forms of violations, including what was previously leaked regarding rape, threats of blackmail, and extracting confessions under brutal and excessive torture. The culmination of the torture of the new victim, resulting in his death, imposes an obligation to open an immediate and urgent investigation and provide a full opportunity for the participation of lawyers and their union, the Human Rights Commission, Iraqi human rights organizations, the Iraqi Jurists Association, and the Parliamentary Human Rights Committee, with the necessity of involving an international human rights party and also the direct presence of (UNAMI) to reassure the victim’s family that his rights will be met and to provide a guarantee that he did not enjoy during his life, as was revealed by his loss of life before the truth was leaked and exposed.
The entirety of what is happening behind bars, with all this secrecy and obfuscation, leads to such disastrous outcomes, and what it means in the dictionaries of rights and freedoms. This requires global solidarity, both popular and official, to provide appropriate pressure to meet just demands and prevent the recurrence of such crime. We believe that procrastination and delay will perpetuate the approach of concealment and the systematic concealment of violations against citizens’ rights to protection and justice.
Let these violations end and let us transform the prison and detention centers into institutions for justice and truth-telling, not centers of retaliation or places of violations and justification for goals that are not subject to law or human rights regulations. Let the demands for referring those responsible for torture and assaulting victims to justice be fulfilled, regardless of their ranks and job titles. In light of the data of the recent incident, it is necessary to punish the detainers who assaulted the victim, and in the context of the more profound and comprehensive tasks of introducing a specialized course in human rights for training police officers and recruits.
We stand in full solidarity with the victim’s family in securing a guarantee for their son’s rights, even after his death and the forfeiture of his right to life.
